A court case in the ongoing dispute between Apple and Samsung began yesterday in San Jose, California, with the iPhone producer suing for $2.5 billion in damages for patent infringement by the South Korean company. Apple claims that Android, Google's OS that powers Samsung smartphones, has features based on Apple's iOS. It also levies the charge that Samsung smartphones are based on the look of the iPhone. Samsung denied the claims and countered, alleging five infringed patents, two of which relate to the use of 3G technology, demanding up to 2.4% in royalties per device sold. Jury selection began Monday for the first case to be held in US of a patent war that has spanned four continents. Apple has gone after many Android-based product manufacturers, and many have in turn filed countersuits, though declining to go after Google directly. The Wall Street Journal's Jessica Vascellaro points out that the Ninth Circuit case may have far-reaching implications, potentially affecting the many other suits being tried across the globe by bolstering either sides' case. In late June, Apple was able to strike the first blow on US soil. Judge Lucy Koh, who is presiding over the case, ordered a preliminary injunction of sales of the Galaxy Tab 10.1. |
